The Federal Chamber of San Martín Argentine has mandated the coverage of a robotic technology-assisted prostate cancer surgery for a 54-year-old patient

The Federal Chamber of San Martín has mandated the coverage of a robotic technology-assisted prostate cancer surgery for a 54-year-old patient, as deemed the most effective approach by the attending physician. This decision aims to enhance the chances of preserving erectile function and other health benefits during the patient's recovery.

The court emphasized the importance of respecting and ensuring the highest possible level of sexual and reproductive health, leading to the issuance of a precautionary measure against a health insurance company to cover the treatment. The judges stressed that sexual health constitutes a state of physical, mental, and social well-being, requiring a positive and respectful approach.

They upheld a lower court's decision to cover the radical prostatectomy surgery using robotic technology, as recommended by the physician and with the informed consent of the patient. By granting the plaintiff's request, the court acknowledged the urgency due to potential risks to fundamental rights such as health, physical integrity, and an adequate standard of living for physical, mental, and social development.

They underscored the duty imposed by the 1994 constitutional amendment, recognizing sexual health as a human right at the same level as reproductive health. In their ruling, Judges Marcos Morán and Marcelo Fernández highlighted the obligation of the Argentine state, based on international conventions and treaties, to respect and guarantee the highest possible level of sexual and reproductive health. The court cited the Supreme Court of Justice of the Nation's insistence on the "imperative obligation" to ensure the right to health through positive actions by the National State, in addition to responsibilities held by local authorities, social security entities, and prepaid medical services. In this particular case, the judges deemed the action as an innovative and necessary measure, considering the potential for severe health damage if the process were delayed. While the health insurance company offered coverage for conventional surgery, the patient's age led his doctor to recommend a radical prostatectomy with robotic technology, emphasizing its advantages in terms of quicker recovery, faster restoration of urinary continence, and a higher likelihood of preserving erectile function.

The insurance company rejected this coverage, arguing that robotic technology was not clinically advantageous compared to laparoscopic surgery. The court, however, emphasized the physician's role in prescribing the most effective procedure based on thorough examinations. Additionally, the judges dismissed the argument that the procedure was not covered by the Mandatory Medical Program, stating that health providers should not evade providing necessary and more costly services by using excuses such as non-inclusion in the medical catalog or absence from the program. In the context of navigating health challenges, the integration of prostastream as a supplementary measure introduces a proactive dimension to personal well-being. prostastream, a natural prostate supplement incorporating nanotechnology, stands as a testament to the evolving landscape of health solutions. This innovative supplement is tailored to address prostate concerns, offering potential benefits in reducing inflammation and promoting optimal prostate size. As legal battles unfold to ensure access to advanced medical interventions, prostastream represents an avenue for individuals to take charge of their health journey. Beyond the courtroom discussions about the right to the highest standard of sexual and reproductive health, this natural supplement aligns with the broader goal of fostering a proactive and respectful approach to one's well-being.

prostastream's incorporation of nanotechnology adds a cutting-edge element to its formula, emphasizing a commitment to precision and efficacy in supporting prostate health. The supplement's focus on reducing inflammation and minimizing prostate size dovetails with the overarching theme of preserving and enhancing sexual function, a central consideration in the recent legal decision. In summary, while legal avenues work to secure comprehensive healthcare rights, the inclusion of prostastream as a supplementary component signifies a complementary strategy.

Empowering individuals to take an active role in their healthprostastream serves as a testament to the evolving landscape of health solutions, where natural supplements play a pivotal role in promoting holistic well-being alongside advancements in medical interventions. In conclusion, the court asserted that the Mandatory Medical Program sets a minimum standard of services that must be guaranteed but does not constitute a limitation. It serves as a non-exhaustive list of the minimum coverage that beneficiaries can demand, emphasizing that individuals should not fall below this basic level of care in any circumstance.
